e) “Intellectual Property Rights” means (i) copyright, rights related to or affording protection similar to copyright, patents and rights in inventions, database rights and rights in trademarks, service marks, logos, get-up, rights in internet domain names and website addresses and other rights in trade names, designs, know-how, trade secrets and other proprietary rights confidential information (in each case whether registered or unregistered); (ii) any registration of and applications for registration, and the right to apply for registration for any of the rights listed in (i) above that are capable of being registered in any country or jurisdiction; and (iii) all other rights having equivalent or similar effect in any country or jurisdiction.

f) “Content” means any information, documents and materials on the Website and any text, software, database, format, graphic and written work, briefing, newsletter, press release, news item, guide, article, case report and any other material, document or html reproduction, whether on the Website or downloaded from it.

The User also agrees with the following: (a) To comply with all applicable laws and regulatory requirements relating to the User’s use of this Website and the services provided therein, and not to use this Website to distribute any information or data in contravention of the laws in force in the Kingdom of Saudi Arabia, including, without limitation, laws and requirements relating to cybersecurity, personal data protection, anti-cybercrime, and intellectual property rights. (b) To comply with the cybersecurity controls and requirements issued by the National Cybersecurity Authority, and use the Website in a secure manner. (c) To comply with the Privacy Policy and any other policies published separately on the Website; (d) To be responsible for all telecommunications charges relating to the User’s use of this Website. If required and necessary should the User need the usage of a third-party software to access this Website, the User will obtain a license of such software at the User’s expense (or the expense of the User’s employer as the case may be); (e) To access the Content solely for the User’s own private use; and not to copy, amend, reproduce or distribute the Content without obtaining our prior written consent; and (f) To not use the Website for any commercial purpose.

The Foundation implements appropriate security controls and measures, as it deems appropriate, based on risk assessments, to protect the Website and the related systems, enhance access security, and safeguard data, in accordance with applicable laws and regulations and the Foundation’s approved security policies and procedures.

The Foundation will implement appropriate technical and organizational measures, as it deems appropriate, to protect the Website and its services, as well as the related infrastructure, systems and applications, including the application of the cybersecurity controls and requirements issued by the National Cybersecurity Authority, to the extent applicable to the nature of the Foundation’s services.

The Foundation does not guarantee that the Website will be error-free, uninterrupted, or immune to technology downtimes, viruses, worms, or unauthorized access attempts by hackers. The Foundation, in accordance with the Personal Data Protection Law and its Implementing Regulations, will adopt appropriate organisational, administrative, and technical measures to protect personal data and manage any personal data breach or cybersecurity incident in accordance with applicable legal requirements. The User shall, where they suspect a cybersecurity incident, unauthorised access to their account, or any unusual activity relating to the Website or the services, notify the Foundation immediately via [reporting channel/email/contact form] and provide any information available to them regarding the incident.
